What is Form I-751?

Form I-751 is the petition a conditional resident uses to ask USCIS to remove the conditions on their residence.

If USCIS grants it, the residence stops being conditional. It is a different filing from a card replacement, even though both end in a new card.

Conditional resident cards are valid for two years, not ten. Look at the dates printed on your card: that is where the difference shows.

If you file it jointly with your spouse, the instructions ask you to file in the 90 days before your conditional residence expires. USCIS warns it may reject one that arrives earlier.

The instructions describe two routes: filing the petition together with the spouse, or asking USCIS to stop requiring that signature when it is not possible.

Which of the two applies to you is a legal question, and sometimes a delicate one. Paso Libre does not answer it and does not choose for you.

People almost always gather a copy of the conditional card, front and back, and documents showing a shared life: accounts, leases, policies, children's birth certificates.
